Terms & Conditions

Please read these Terms & Conditions as they affect your rights and responsibilities in law. If they are not acceptable to you please do not order from us. That having been said these Terms & Conditions do not affect your Statutory Rights.

1 Interpretation

1.1. Definitions

• Buyer/You the person or business who purchase the goods from the company
  
• Company/We Archturus Limited (Company Number SC305420) Strathenry House, Strathenry, Glenrothes, Fife KY6 3HY which is our registered office and trading address
  
• Goods – any goods supplied to the Buyer by the Company
• Site www.archturus.co.uk.

1.2. Singular words include the plural and vice versa.
1.3. Reference to gender covers both genders.
1.4. The Site is intended for use by persons or businesses resident in the United Kingdom.
1.5. The Site is available free of charge for personal and business use.

2. Product Terms

2.1. Orders placed and purchases made are governed as follows:
2.1.1. All prices show are retail selling prices inclusive of value added tax unless otherwise stated.
2.1.2. All prices are subject to change without notice being given.
2.1.3. Should we not be able to supply an item for a reason beyond our control we will not accept liability.
2.1.4. Placing an order does not necessarily mean we will fulfil it. Only when we invoice and dispatch the Goods is the Contract between the Buyer and Company acknowledged and confirmed.
2.1.5. Delivery will be made to the address given when placing your order.
2.1.6. Depending on the size and nature of the order it will be dispatched either by first class Royal Mail or by next day courier.
2.1.7. Under normal circumstances orders will be dispatched before end of play on the day the order is received.
2.1.8. Carriage charges to UK destinations excluding Channel Islands and Isle of Man are as follows:
For orders under £40, the postage and packaging fee is a flat £2.50.
For orders over £40, postage and packaging is free.
For items weighing more than 500g (this includes liquid supplements from 450ml) there is a £5 postage and packaging surcharge. In the event that 2 or more of such heavy items being ordered, each subsequent heavy item would incur an extra £2.50 postage and packaging charge. Due to the cost of packaging for heavy items, these rules apply even if the order total is over £40.
Books attract a £2.50 carriage surcharge, but this is waived if the total of the order is over £40. In the event of an order containing more than one book for which the total were less than £40, each additional book would be charged an extra £2.50 as postage and packaging fee.
2.1.9. Carriage charges to European destinations are as follows:
There is no free of charge postage and packaging for European orders. For all European orders there is a flat postage and packaging fee of £5. Each additional item incurs a £2 charge. Heavy items incur a surcharge of £7.50 for the first, and £2.50 for any subsequent ones. Books incur a surcharge of £5 each.

2.1.10. Carriage charges to all other worldwide destinations:
There is no free of charge postage and packaging for worldwide orders. For all worldwide (non-UK, non-European) orders there is a flat postage and packaging fee of £7. Each additional item incurs a £2 charge. Heavy items incur a surcharge of £7.50 for the first, and £2.50 for any subsequent ones. Books incur a surcharge of £5 each.

2.1.11. If Royal Mail or our couriers fail to delivery your Goods in part or in full or it is beyond our control we will not be held liable. However, we will use our best endeavours to ensure you are recompensed for the loss.
2.1.12. Goods may be returned providing Customer services are advised by telephone (01592 620 865) or by email (orders@archturus.co.uk) beforehand and the Goods have not been opened.
2.1.13. Any items damaged must be notified within 48 hours of receipt (see 2.1.10 for telephone or email).
2.1.14. An order may be subject to cancellation or changed by sending an e-mail or by telephone (see 2.1.12). If the order has been processed and dispatched you will need to return it to us for full credit less cost of carriage.
2.1.15. Payment may be made by all major debit and credit cards, all in pounds sterling. You will not be charged for any Goods until they are dispatched. Our liability to you relating to any order will not exceed the total value for the particular goods.

3. The Law

These Terms & Conditions as numbered 1 to 16 shall be governed by and construed in accordance with the laws of Scotland and the Scottish Courts will rule over any disputes. If any of the Terms are held by any Court or competent authority to be unlawful, invalid or unenforceable in whole or part, this will not reflect in the validity of the other terms which will still be valid and enforceable to the extend allowed by law.

4.Amendments

We reserve the right to amend these Terms & Conditions and will publish these on our site as they occur and apply from the day of publication.

5. Registration

5.1. When registering on our website do be sure that your details are accurate and complete. This will allow us to be in touch, should there be any delays with your order.
5.2. Remember to let us know immediately if any of your details change.
5.3. Some our products are available to practitioners only. When you apply to register as a practitioner, please send us a copy of any certificates that prove your eligibility to practice in the UK, such as copies  of the following documents:

• Your university or college diploma/certificate.
• Full BANT or NIMH membership certificate.
• Malpractice insurance certificate, e.g. Balens
• CNHC and/or HPC registration certificates.

Please email these to orders@archturus.co.uk or post a photocopy to Archturus Limited, Strathenry House, Strathenry, Glenrothes, Fife KY6 3HY. Please do not post any original documents.
5.4. We reserve the right to use your contact details, such as email or postal addresses, to send you information about our products. The amount of information to be sent will never be abusive and is only a reflection of your interest in our products, shown by your registration on our website.
5.5. Email communication may be in the form of product information, offers and promotions that we believe would be of interest to you.
5.6. When registering you will automatically be subscribed to our newsletters.

6. Security

6.1. When first registering on the Site you will need to create and enter your password, which must remain strictly confidential. Please do not share your password with anyone. 
6.2. Your password is your responsibility. All orders submitted under this password will be your responsibility.
6.3. If Archturus Limited suspect that there might be a breach of security or that our site is being misused you may be required to change your password or we may be obliged to suspend your account.

7. Promotions

7.1. Promotions are available from time to time and these have time limits and/or while stocks last. Should the promotion have finished prior to receiving your promotional order we will notify you before sending the Goods.
7.2. Refunds are not normally given against promotional offers. Much depends on the terms of the offer. However your statutory rights are not affected.

8. Intellectual Property

8.1. The content of our site is protected by copyright trade marks, database and other intellectual property. You may retrieve and display the content of the Site on a computer screen or save on a disc. You may also print one copy for your own personal use. However you may not store on a server or any other storage device connected to a network and you may not use our information for business purposes without our consent.
8.2. You may not use any trade mark of Archturus including Archturus Limited without our explicit prior consent.

9. Site Availability

9.1. Archturus Limited endeavours to offer the best possible service. Nonetheless it cannot guarantee that the service will always be without fault or meet all your needs. Should a fault occur we would be grateful if you report it to us by telephone (01592 620 865) or email (orders@archturus.co.uk).
9.2. Site access may not always be available as a result of maintenance or the addition of new products. We apologise in advance for any disruption to our service this may cause.

10 Right To Cancel Registration

10.1. You may cancel your registration at any time by emailing us at support@archturus.co.uk.
10.2. You may also unsubscribe from our email communications by using the “unsubscribe” link you will find on the footer.
10.3. Should you choose to cancel your registration, you must stop using the site
10.4. Cancellation shall not affect your rights or liabilities.

11. Our Right to Cancel Your Registration

11.1. Archturus Limited reserves the right to cancel your registration at any time should you breach any of your obligations under these Terms & Conditions.
11.2. For Practitioners of Nutritional Therapy and Herbalism. We reserve the right to ask you to produce a current membership certificate for your professional association, as well as a copy of your malpractice insurance certificate. We reserve the right to cancel your registration with immediate effect should you fail to produce the aforementioned documents, cancelling also any pending orders you may have placed with us which are yet to be fulfilled.

12. Our Liability

12.1. Archturus Limited provides the Site without any warranties or guarantees. The risks associated with use of the Internet shall be borne by you. This includes the risk of any device you may use to access our Site of getting infected by malware or viruses.
12.2. Material from other Internet sites is provided by our Site. We try to ensure this material is of good quality, reputable and within the law we cannot be held responsible if this proves not to be the case.
12.3. Neither can we be held responsible for any technical problems experienced with the Site and we disclaim all liabilities where your equipment links are incompatible or interruptions or errors due to technical problems occur.
12.4. You also accept that we cannot be held responsible to you or any third party for any incidental damage or considerable loss of revenue that are concerned with the Site insofar as applicable law allows.

13. Overseas Use

13.1. Archturus Limited cannot know that information and materials on its site are appropriate or available for use anywhere outside the United Kingdom. If you reside outside the UK and you decide to order any product from this Site you do so on the understanding that is it on your own initiative and it is your responsibility to comply with local law.

14. Privacy

14.1. Any information submitted by you on this Site is for the use of Archturus Limited only. We do not release any names, addresses of information relating to those names and addresses to any person, any business or organisations outside the Company.

15. Third Party Websites

15.1. The Site has links to other websites which are outside our control and Archturus Limited is not responsible for Internet content or World Wide Web pages.

16. Advertising

Any advertising on the site not generated by the Archturus Limited is the responsibility of advertisers and they must ensure it complies with all relevant laws and codes. We will not be responsible for inaccuracies in advertising material.
